Charges: The package fee is based on the Photographer’s Pricing Sheet and includes the photographs
described therein. If the fee is not based on a package but is a session fee, all photographs shall be billed in
addition to the fee and in accordance with the Standard Price List. In addition to either the package fee or the session fee, the extra charges set forth below shall be billed if and when incurred.

The parties have read both the front and back of this Agreement, agree to all its terms, and acknowledge receipt of a complete copy of the Agreement signed by both parties. Each person signing as Client below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.

This Agreement is subject to all the terms and conditions appearing on the reverse side.

1. It is understood this The Photographer is the exclusive official photographer retained to perform the photographic services requested on this Contract.
2. All negatives and/or other images remain the exclusive property of The Photographer. The photographer holds the exclusive copyright. It is illegal to copy or reproduce images or photographs elsewhere without the photographer’s permission. All images are copyright protected unless a copyright is purchased from the photographer.
3. No part of any order, including previews, will be delivered until the balance is paid in full.
4. The Photographer reserves the right to use negatives, reproductions, prints, CD’s, DVD’s, and the like for displays, publications, exhibitions, portfolio books, brochures, advertisements or other marketing purposes unless otherwise determined.
5. Upon signature, the Studio/Photographer shall reserve the time and date agreed upon. Unless the Studio is able to fully replace the cancelled reservation, all sitting fees and deposits are non-refundable, even if the portrait is rescheduled or canceled for any reason other than inclement weather.
6. At the time of delivery of the photographs, the Client(s) have the duty to inspect the photographs, CD’s DVD’s, etc. for color and quality defects. Within 14 (fourteen) days of the delivery, the Client(s) must give the photographer written notice (e-mail accepted) of the evidence of such defects or all rights to claim damage and/or repairs are deemed forfeited.
7. If the photographer cannot perform this contract due to a fire or other casualty, strike, act of God, or other cause beyond the control of the photographer, or due to the photographer’s illness, then the photographer shall reschedule the portrait session as the Client’s request or, in the alternative, shall return any deposit made to the Client(s) but shall not have further liability with respect to this contract.
8. The Photographer agrees to keep all ordered negatives and/or digital files ordered from your initial order for a period of one year from the session date. However, all unordered images will be purged after 90 days.
9. Should you not be satisfied with the final proofs, please call the photographer to discuss your concerns. The Photographer strives to provide you with images you will adore for years and years to come, and your satisfaction matters. However, having a redo will be at the photographer’s discretion.
